The Dominican Republic "DR" is a Latin American country located on two-thirds of the Caribbean island of Hispaniola sharing a common border with Haiti. This island is the 2nd largest of the Greater Antilles islands and lies west of Puerto Rico. For much of the 20th century, the government of the Dominican Republic was unsettled. Since the death of its military dictator Rafael Leónidas Trujillo in 1961 the Dominican Republic has been moving towards representative democracy.

A law was passed in 1998 allowing foreigners to purchase real estate in the Dominican Republic with the same rights and obligations as its citizens. Title Registry Offices do require a non-citizen to register the purchase to keep a record, for statistical purposes, of all purchases made by foreigners. Buying a home here is straightforward but foreigners purchasing property anywhere in the world outside their home countries need to exercise caution. The real estate agent and the "notario" (a real estate attorney) you work with can help you through the process. But hire your own attorney as well. Buying real estate in the Dominican Republic is different than in the United States. Instead of submitting a written offer, you negotiate with the seller and reach a verbal agreement on the price. Then, a binding “Promise of Sale” or “Option to Purchase” is prepared by an attorney and signed by all parties. At this time an advance payment is normally made. Some attorneys and notaries in the DR do not protect the buyer adequately in the “Promise of Sale.” As an example, buyers are asked to pay a large percentage of the sale price without any security or direct interest over the property. If these funds are misused, the buyer’s only recourse is to sue the seller personally. This can be particularly disconcerting if a bank forecloses on the property. Even if the developer has not performed his basic obligations, you could still be responsible for making your payments as contracted. Get a trustworthy, reliable attorney, and title insurance. In the Dominican Republic, as in many Latin American and European countries, the government provides title insurance but this governmental arm is not known for its solvency, so seek out a private insurer like an American title insurance company. Four Steps To Purchasing 1. Seller and Buyer sign a “Contract of Sale” before a notario who authenticates it. Notaries in the Dominican Republic are required to obtain a law degree. The Contract of Sale contains the price, the conditions of sale, and the legal description of the property. 2. For payment of the appropriate taxes the Contract is then taken to the nearest Internal Revenue Office. 3. The Contract of Sale and the Sellers Certificate of Title are deposited with Title Registry Office for the jurisdiction where the property is located, and the sale is recorded. 4. A new Certificate of Title in the name of the Buyer is issued by The Title Registry Office the old Sellers Certificate issued previously is canceled. From the filing of the Contract of Sale to the issuing of the new Certificate of Title may vary from a few days to a few months, depending on the Title Registry Office where the sale is recorded.
